RULES AND REGULATIONS

This document serves as a supplement to the rules and regulations established in the Condominium Declarations, the Articles of Incorporation, and the By-laws of Capstan Club Condominium.
- KEY ACCESS TO UNITS
- The Association shall retain a current copy of keys to access all units.
- If a lock is changed, the Association and/or the Property Management company must be notified, and a new key supplied by the owner within 2 weeks.
- RENTING OF UNITS
- All rentals must be for a period of thirty (30) days or longer.
- Owners are responsible for providing tenants, guests, and lessees with a copy of these Condominium Rules and Regulations, emphasizing their importance, and ensuring compliance.
- The Property Management company MUST be notified in advance of the identity of the tenants, their expected date of arrival, and the period for which they will be staying. Request forms for Renters and Guests are available from the Property Management company.
- CONDOMINIUM USE AND MAINTENANCE
- The condominium shall be maintained in a clean, sanitary, and pest-free manner.
- Garbage and other non-recyclable refuse must be placed in securely tied plastic bags and deposited in the trash bin located at the entrance of the parking lots for Buildings #1 and #4. Glass, plastic, cardboard, and other recyclable items should be placed in recycling bins across from the trash bin. Cardboard should be broken down or crushed to fit into the recycle bins. The trash collectors will not pick up any item not in the dumpster. The owner must independently dispose of all large items, such as appliances and furniture.
- No practice that is annoying or a nuisance to residents, or that interferes with the peaceful possession and proper use of the property by the residents, is allowed upon the condominium property.
- Towels, swimsuits, clothing, etc., shall NOT be draped over lanai railings. No signs of any type shall be displayed by any unit owner on condominium property.
- Children and pets on Capstan property must be properly supervised.
- All windows and sliding glass doors must have coverings. All window, door, and screen coverings visible from the exterior of the building shall be neutral in color or shall have a neutral color lining.
- Residents planning to be away for 7 days or more must shut off their unit’s main water valve. A home watch service is recommended to check unoccupied units for significant issues (such as mold, water leaks, AC problems). Significant issues must be reported immediately to the Association.
- POOL USE
- THERE IS NO LIFEGUARD ON DUTY – USE THE POOL AT YOUR OWN RISK. DIVING INTO THE POOL IS PROHIBITED.
- No pets or glassware inside the fenced pool area
- No food or drink in the pool.
- No running in the pool area.
- No smoking in the pool area.
- Proper swim attire only.
- Pool facilities are solely for the use and enjoyment of owners and guests/renters of Capstan Club. Pool hours are 7:00 AM to 10:00 PM. Pool hours will be suspended while undergoing maintenance.
- Children under the age of 15 must be supervised by an adult within the pool fence.
- No portable sound devices are permitted unless headphones/earphones are used to ensure audio is not disruptive to others.
- No incontinent individuals in the pool
- When in swim attire, place a towel over a chaise lounge or chair.
- One adult per chaise lounge or chair.
THE ASSOCIATION RESERVES THE RIGHT TO REFUSE ADMITTANCE TO OR EJECT FROM THE POOL AREA ANY PERSON FAILING TO COMPLY WITH THE POSTED HEALTH AND SAFETY REGULATIONS.
- COURTYARD AND GROUNDS
- Unit owners are permitted to have approved indoor pets. It is the owner’s responsibility to ensure that pets behave in a quiet, non-threatening manner. While on common property, pets must be on a leash no longer than ten (10) feet and under their master’s control. Pets must not be allowed to urinate or defecate on walkways or near common ground plantings. ALL DROPPINGS MUST be retrieved in a sealed PLASTIC BAG and placed in the trash. Pets are not allowed in the courtyard under any circumstances. NO RENTER MAY HAVE PETS UNLESS THEY RENT FOR MORE THAN SIX MONTHS AND RECEIVE WRITTEN PERMISSION FROM THE BOARD OF DIRECTORS.
- Bicycle riding, skateboards or in-line/roller blade skating is not permitted on any walkway or sidewalk.
- All lighting, decorations, potted plants, furniture, etc. within the common areas (sidewalks, railings, parking area, pool area, etc.) are prohibited unless approved by the Capstan Board. Solar-powered holiday lighting or other holiday decorations are permitted on the upper-level walkway railing from November 20 through January 7th.
- First floor units are permitted to use electric, propane, and charcoal grills outside of their lanais if they are at least 10' from the building and not on common walkways. Storage of large LP tanks inside individual units is prohibited. The maximum amount of LP permitted within a unit is limited to cylinders each with a maximum capacity of 2.7 lbs. (1.2 kg) and shall not exceed 5.4 lbs. (2.4 kg) in aggregate.
- Second floor units are permitted to use electric portable grills on their balconies as long as the surface area is < 200 square inches.
- PARKING
- Personal vehicles such as cars, SUVs, trucks, vans, motorcycles, and golf carts that do not exceed the size of one parking space may be parked in the areas provided for that purpose. Commercial vehicles are NOT permitted unless services are actively being performed on Capstan property.
- Vehicle maintenance, car and boat washing is not permitted on the Condominium Property.
- All vehicles must be currently licensed; no inoperable or unsightly vehicles may be kept on Capstan property.
- Capstan Club residents who will be towing boats on trailers, campers, and RVs are permitted to park in the parking lot for 24 hours, and only for the purpose of loading or unloading, and shall not impede other vehicles.
- Parked motorcycles must use a stand plate to avoid damage to the parking lot. Unit Owners with motorcycles are asked to please be considerate of their neighbors and to minimize noise to start their motorcycles.
- Residents with golf carts are requested to park away from prime parking spots. Residents with electric golf carts are prohibited from charging their golf carts using electricity from their unit, as electrical cords on walkways present a tripping hazard.
- A golf cart charging station is available for use near Building #3. Usage of the golf cart charging station requires a payment specified by the association – please contact the Property Management company for details. Electric vehicles are prohibited from using the golf cart charging station.
- Bicycles must be parked in the bike racks beneath each stairwell. Residents are required to move bikes into their units when their unit is unoccupied for an extended period of time and during the hurricane season.
- HURRICANE READINESS (Applicable during the hurricane season June 1st - November 30th)
- Unit Exterior: All items on screened lanais, front doors, railings, bike racks, walkways, the courtyard, etc., must be stored inside your unit while it is unoccupied. For items not secured at least three (3) days before a named storm is forecasted to arrive in our vicinity, the Association reserves the right to move items inside the owner’s unit at the owner’s expense.
- Golf Carts (Seasonal Residents & unoccupied units): All rented or owned golf carts must be stored off Capstan Club property. Carts not stored off Capstan Club property during the hurricane season will be removed and stored at the owner's expense.
- Golf Carts (Full-Time Residents): Residents staying through the hurricane season must move their golf carts off Capstan Club property at least three (3) days before any named storm is forecasted to arrive in our vicinity.
